Terms of Service / Allgemeine Geschäftsbedingungen (AGB)

1. Scope

These Terms of Service apply to all orders placed by consumers and businesses via our online shop luveliostore.com, operated by Luvelio, Owner: Oskar Tkachuk, Birrenkovenallee 13, 22143 Hamburg, Germany (hereinafter “we” / “us”).

2. Conclusion of contract

The presentation of products in our online shop does not constitute a legally binding offer, but an invitation to place an order. By clicking the order button, you place a binding order for the goods in your shopping cart. The purchase contract is concluded when we accept your order by sending an order confirmation e-mail or by shipping the goods.

3. Prices and payment

All prices are total prices in EUR and include the applicable statutory value added tax. Any shipping costs are displayed during checkout before the order is placed. Payment is made using the payment methods offered in the checkout.

4. Shipping and delivery

We ship internationally. Unless otherwise stated on the product page, the estimated delivery time is 8–12 business days after order confirmation. If a product is unexpectedly unavailable, we will inform you immediately and refund any payments already made without delay.

5. Retention of title

The goods remain our property until full payment has been received.

6. Right of withdrawal

Consumers have a statutory right of withdrawal of 14 days. Details can be found in our Right of Withdrawal policy, including the model withdrawal form.

7. Warranty

The statutory warranty rights apply. In the event of defects, you are entitled to the statutory claims for subsequent performance, withdrawal, reduction of the purchase price and damages within the statutory limits.

8. Liability

We are liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body or health. In cases of slight negligence, we are only liable for the breach of essential contractual obligations (cardinal obligations), limited to the foreseeable damage typical for the contract. Liability under the German Product Liability Act remains unaffected.

9. Applicable law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law only applies to the extent that the protection granted by mandatory provisions of the law of the state of the consumer's habitual residence is not withdrawn.

10. Online dispute resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/. We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
